GUSTO – TERMS OF SERVICE

1 ACCEPTANCE

By downloading, installing, or using the Gusto app you agree to these Terms and our Privacy Policy.

2 ELIGIBILITY

You must be 18 + (or legal drinking age in your jurisdiction) to use Gusto.

3 ACCOUNT RESPONSIBILITIES

Provide accurate information, keep your password secure, and notify us immediately of any unauthorized use.

4 LICENSE

We grant you a personal, revocable, non-exclusive, non-transferable license to use the app. You may not reverse-engineer, decompile, or resell any part of the service.

5 USER CONTENT

You own your tasting notes, ratings, photos, and other content but grant Gusto a worldwide, royalty-free license to use, display, reproduce, and adapt that content in connection with the service. You are responsible for content you submit.

6 PURCHASES & PAYMENT

  • Wine orders are fulfilled by independent, licensed retailers.
  • Gusto is a facilitator; the retailer is the seller of record.
  • Prices, taxes, and availability are set by the retailer.
  • All sales are final unless the retailer’s policy states otherwise.
  • Payment information is processed securely by Stripe; Gusto never stores full card numbers.

7 RESPONSIBLE CONSUMPTION

Drink responsibly and comply with local laws. Gusto provides information, not medical or legal advice.

8 DISCLAIMER

Service provided “AS IS.” We disclaim all implied warranties including merchantability, fitness for a particular purpose, and non-infringement.

9 LIMITATION OF LIABILITY

To the maximum extent permitted by law, Gusto’s total liability will not exceed (a) US $100 or (b) the amount you paid us in the 12 months preceding the claim, whichever is greater.

10 INDEMNITY

You agree to indemnify and hold Gusto harmless from any claims arising out of your misuse of the service or violation of these Terms.

11 TERMINATION

We may suspend or terminate your account for any violation of these Terms. You may delete your account anytime in Settings.

12 GOVERNING LAW & DISPUTE RESOLUTION

These Terms are governed by California law. Any dispute will be resolved by binding arbitration conducted in San Francisco, California, under the AAA Consumer Arbitration Rules. You waive any right to participate in class actions.

13 CHANGES TO TERMS

We may update these Terms at any time. Continued use after we post changes constitutes acceptance.
